Following downpours, restoration expert weighs in on water damage, cleaning up
While severe weather is not expected, more rain forecasted for late week

The CDC said studies have found a potential link of early mold exposure to asthma in children.
And while homeowners can take steps to reduce or eliminate mold in their homes, there are no laws or substantial protections for renters in New Jersey — unless a landlord is willing to help.
Anthony Paredes, his girlfriend and their 17-month-old baby said they are learning that the hard way.
They said their apartment in Mill Run at Union is infested with mold.
“It is unsafe, unhealthy and I do not want my daughter developing any asthma or health problems related to this,” Paredes said. “[The management] knows that there is an issue and still right now are treating it like a joke.”
The management at Mill Run, which has 1,100 one- and two-bedroom apartments, wouldn’t comment on the Paredes’ apartment specifically, but said it takes all mold complaints very seriously.
There was no apparent mold when the family moved in on Nov. 15, 2019, Paredes said, only the strong smell of fresh paint.
Soon after they put their furniture in place, they noticed the dampness.
“With any amount of heat on, it just became extremely humid and damp within the apartment and the walls, floor, windows and our clothes would literally be moist to the touch,” he said.
After a few weeks, they saw green mold on the windows. Then a few days before Christmas, there was an awful discovery.
Paredes said he was cleaning the apartment so he moved the bed to sweep underneath.
“To my complete shock I found a huge mold spot growing on the wall behind the bed where my daughter sleeps, about two feet by two feet, black-greenish in color,” he said.
He said he cleaned the spot but the mold grew back in a few short days, so he called Mill Run.
For the next two months, Mill Run sent several workers to clean the mold, but it kept growing back, Paredes said.
One time, management promised to send “an inspector,” Paredes said, but the inspector was just another maintenance worker.
“Instead of doing anything about the mold, we were scolded about what we were doing wrong regarding the moisture buildup in the apartment and given instructions on how to reduce the moisture content,” he said.
They were told to leave the windows open during the winter to ventilate the apartment, to keep the heat no higher than 66 degrees, to remove a humidifier they had for their daughter and to pull the furniture off the walls so there was space to breathe, he said.
Paredes said the family followed the instructions, but the mold grew back as strong as ever.
After Paredes threatened to call the Union Board of Health, management sent yet another worker to clean the mold, he said. Later, the management suggested the family wasn’t following the instructions, he said.
Paredes disagreed.
The mold has since spread to their mattress, clothing, their couch, and even their baby’s sneakers.

“It is as if I’m living in a nightmare with these people. How can we basically be told it’s our fault when all we’re doing is just living there like everyone else? I’ve asked many people around our apartment and no one seems to have a problem like we do,” he said.
GETTING A DIAGNOSIS
Paredes called the Board of Health. An inspector came to the apartment, confirmed the mold and suggested the family hire an independent mold expert.
At a cost of $450, the family’s mold pro came to the apartment on Jan. 9.
“We have a full report stating that there is 100% moisture on many areas of the apartment and that it is definitely mold that is all over,” Paredes said. “He even pointed out the areas of the apartment which he thought were fueling the mold issue, which is structural damage outside with literally openings and breakage in the brick that lets in air and moisture.”
The mold expert suggested they move out and take their property with them as soon as possible for health reasons, but the family said they can’t afford to move.
Paredes gave a copy of the report to the management office, and the office sent other maintenance workers. One took photos of the mold. Another did work with the bricks outside the apartment and a window.
Finally, on Jan. 27, management sent its own mold expert, Paredes said.
Paredes said the expert blamed the mold on the heat and poor ventilation, recommending the same steps previous workers suggested.
But he was already doing those things, Paredes said.
“Yet it already grew back and now we are here at square one,” he said.
They asked Bamboozled for help.
CAN THE STATE HELP?
If you have lead paint, asbestos or radon gas in an apartment, New Jersey has laws to protect you.
But no one really has any authority to combat mold — not in New Jersey, and not federally, either.
“There are no regulations by a state agency regarding mold,” said Lisa Ryan, a spokeswoman for the Division of Community Affairs (DCA), which regulates many landlord issues in the state.
The Hotel and Multiple Dwelling Law gives DCA the power to issue and enforce regulations and to levy penalties to ensure that dwellings are maintained to protect the health, safety or welfare of the tenants, she said.
“With that said, DCA has no authority to cite property owners on mold issues directly because mold and its potential health effects are outside of the department’s jurisdiction,” she said.
That’s the problem. It doesn’t fall under anyone’s jurisdiction.
Individual municipalities can pass ordinances that would cover mold. Union, where the couple lives, like many towns, has not.
The bill, which has not yet been reintroduced this session, would make it a landlord’s responsibility to remediate mold and put renters in a safe place until the work is done, Singer said.
“The consumer has nowhere to turn. (Landlords) just ignore it and say if you don’t like it, just move out, and sometimes they would only paint over it,” he said. “You own the apartment, you make the money as a landlord, and the health and welfare of a tenant should be the No. 1 priority a landlord should have.”
The bill would also require a state inspection for mold when there’s a change in occupancy.
LEGAL REMEDIES?
There are several legal remedies tenants can try.
The first is known as “rent withholding.” The tenant can argue the landlord is breaking the lease by not removing mold, which is making an apartment uninhabitable. If you go this way, put your complaint to the landlord in writing and explain you’re saving your rent payments on the side until the repairs are complete.
Another alternative, called “repair and deduct,” is to pay to remediate the mold on your own — if you can afford it. In this case, you should also complain in writing so the landlord knows your intentions, and then you would withhold enough rent to cover the remediation.
Either of these strategies could lead the landlord to start eviction proceedings. You could land in court, where a judge will make a determination.
“In most cases the judge is going to turn to the landlord and say, ‘Why don’t you take care of this?’” said Anthony Vignier, a Kearny-based attorney who has represented tenants and landlords.
While Community Affairs doesn’t have authority over mold, renters can file a complaint with the agency about underlying conditions, such as plumbing issues, that could cause the growth of mold. Assuming the underlying issue falls under DCA purview, an inspector would be sent to do an investigation, DCA said.

But depending on the county, Vignier said, you could have to wait a long time because some local investigators, especially in larger cities, are overwhelmed with complaints.
GETTING ANSWERS
We reached out to Mill Run to see what it planned to do about Paredes’ situation.
In an email, property manager Phyllis Chatelier said Mill Run takes all mold complaints very seriously.
“Out of respect for our residents’ privacy we cannot comment on this specific issue but we can tell you if we ever encounter a mold issue we work diligently to identify the cause and then take corrective action,” she said. “This may include working closely with experienced environmental consulting companies to ensure we are doing everything possible to protect our residents.”
We took that response back to Paredes.
“All of it is absurd and it’s just been too long without any rectification,” Paredes said. “We are still sitting and living in a mold-filled apartment with a toddler who can develop asthma.”
He plans to file a complaint with Community Affairs.
NORMAN, Okla. (KFOR) — Some OU dorms are so damaged, water is coming out of the walls, ceiling, and the floor after a pipe burst, but some students say they’ve been trying to get the problem fixed for months.
It’s a soggy saga for a freshman dorm at OU.
Susie Butler is in Broken Arrow when a panicked call came from her daughter Monday afternoon.
“She Facetimed me and I just saw a flood,” Susie Butler said. “That’s when I freaked out.”
A pipe burst in her daughter’s room, shattering the sheetrock in McCasland Tower.
Water was seen rushing from above and below turning the entire third floor into a swamp.
«Just like a pond in water that was brown and gross,” an OU student said.
Students said they grabbed what they could.
“It was like a waterfall,” another OU student said. “It was just going so fast.”
Two floors were evacuated as a precaution. Maintenance was called in to pump it all out.
But Butler and her daughter tell News 4 they weren’t surprised.
They even submitted a maintenance request all the way back in December to report that something was wrong.
Butler shared a photo from December 13th showing the request saying, ”The air conditioning is leaking water. When I came back from Thanksgiving break, there was water soaking the ground and water rises up when you step on the tiles.”
«They don’t deal with it,” Butler said. “They just kind of put band-aids over the situation.»
“While it’s unclear whether or not today’s burst pip was related to previously issued work order, the result is the same – students found themselves in need of immediate help. Our first concern is to ensure our students’ living arrangements are disrupted as little as possible and that we immediately address any situation that causes disruption. To minimize the disturbance to our students, the University has provided cleaning services to the affected areas, alternative housing for those unable to return to their rooms, and is providing financial assistance as is appropriate for damaged personal items. We will remain in communication with affected students until the matter is fully resolved.”

«We are paying 12 thousand a year just for housing, not even tuition and this is dangerous,” Butler said.
Maintenance workers are still surveying the damage through Monday night. Students are also working with the university the write down all their damaged items to have on record.
